These Terms of Service ("Terms") govern your access to and use of the Fynstream platform, website, and related services (collectively, the "Service") provided by Fynstream ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Account Registration

• You must be at least 16 years old to use the Service.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• One person or organization may maintain multiple accounts only with separate subscriptions.

2. Subscription Plans and Billing

2.1 Plans

The Service is offered through paid subscription plans (Starter, Pro, and Enterprise). Each plan includes specific limits on concurrent streams, viewers, storage, team members, and features as described on our pricing page.

2.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis.
• Payment is processed through Stripe or PayPal. You agree to their respective terms of service.
• All fees are non-refundable except as expressly stated in these Terms or required by law.
• We may change pricing with 30 days' notice. Price changes take effect at your next billing cycle.

2.3 Overages and Limits

If you exceed your plan's limits (e.g., concurrent viewers, storage, stream duration), the Service may restrict additional usage until you upgrade your plan or the current billing cycle resets. We will not charge overage fees without prior notice.

2.4 Cancellation

You may cancel your subscription at any time through your dashboard. Upon cancellation, your account remains active until the end of the current billing period. After that, your streams will be stopped and your content will be retained for 30 days before deletion.

3. Acceptable Use

You agree not to use the Service to:

• Stream, upload, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Infringe upon intellectual property rights of others, including copyright, trademark, or patent rights.
• Stream content that violates the rights of any third party, including privacy and publicity rights.
• Distribute malware, viruses, or other harmful code.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Use the Service for illegal gambling, fraud, or money laundering.
• Resell, sublicense, or redistribute the Service without our written consent.
• Interfere with or disrupt the Service or impose an unreasonable load on our infrastructure.
• Circumvent plan limits, rate limits, or security measures.
• Use automated means to access the Service except through our documented API.

4. Content Ownership and Licensing

4.1 Your Content

You retain ownership of all content you stream, upload, or create through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, transcode, and deliver Your Content solely for the purpose of providing the Service.

4.2 Content Responsibility

You are solely responsible for Your Content and the consequences of streaming or publishing it. We do not endorse or assume liability for any user content. We reserve the right to remove content that violates these Terms.

4.3 DMCA and Copyright

We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe your copyrighted work has been infringed, please contact us with the required DMCA information. Repeat infringers may have their accounts terminated.

5. Embeddable Player

The Service provides an embeddable video player for use on your websites and applications. You may customize the player appearance within the options provided. You may not modify, reverse engineer, or remove branding from the player beyond the customization options available in your plan.

6. API Usage

Access to our API is subject to rate limits and permissions defined by your subscription plan. API keys are confidential and must not be shared publicly. We reserve the right to revoke API access for abuse or violation of these Terms.

7. Service Availability

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.
• We may perform scheduled maintenance with reasonable advance notice.
• We are not liable for downtime caused by factors beyond our control, including internet outages, third-party service failures, or force majeure events.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Termination

• We may suspend or terminate your account if you violate these Terms.
• We may terminate the Service with 90 days' notice, providing you the opportunity to export your data.
• Upon termination, your right to use the Service ceases immediately.
• Provisions that by their nature should survive termination (e.g., limitation of liability, indemnification) will survive.

10. Limitation of Liability

To the maximum extent permitted by law, Fynstream shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Fynstream, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms or the Service will first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

13. Changes to These Terms

We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the Service. Your continued use after the effective date constitutes acceptance of the updated Terms. If you disagree with changes, you may cancel your subscription before the changes take effect.

14. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fynstream regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
